Damages

The Fair Debt Collection Practices Act allows a successful consumer to recover actual damages, statutory damages of up to $1,000 per lawsuit, reasonable attorney fees and costs.

Original Creditors

Technically, the Fair Debt Collection Practices Act does not apply to original creditors, with a few exceptions. However, this does not mean that you are without remedies. If an original creditor commits any of the above violations you may have a claim against them under the Telephone Consumer Protection Act (TCPA), the Colorado Consumer Protection Act (CCPA), the Colorado Consumer Code (CCC), and other common law torts.
