Truth in Lending Act

If you have recently purchased a home, car, or other major item, the attorneys at Matthew R. Osborne PC, can review your contract to look for Truth in Lending violations. Creditors are required to accurately disclose the interest rate on consumer transactions; however, creditors often will give you a 13% loan and tell you that the loan is really 8%.

Common Violations

  • Selling you GAP, credit, disability insurance without telling you it is voluntary
  • Increasing the sales price if you want to finance the item instead of pay cas
  • Charging you a higher sales tax rate than the local rate
  • Charging you a higher "recording fee" than what the State charges the lender
  • Overcharging you on title examination and insurance fees
  • Double or Triple charging you for "document preparation fees"
  • Under-stating the Annual Percentage Rate
  • Not disclosing security interests in the collateral

Remedies for the Successful Consumer

  • actual and statutory damages
  • court costs
  • attorney fees

"Yo-Yo" Car Sales

A new trick that some unethical car dealerships are doing now is selling you a car at an interest rate of 5%. The dealer will tell you that the deal is "conditional" on them finding a lending company to finance you at that rate. Often times, the lending company and the dealership will be owned by the same people. The dealer knows that the lending company will never honor the 5% rate. About a week after you have taken the car home and shown it to your friends and family, the dealership will call you and inform you that the finance company will only "approve" you at 15%. The dealership will often threaten to throw you in jail or have you arrested if you don't sign the new contract.

If this has happened to you, the law firm of Matthew R Osborne PC will help you fight back and may be able to get you actual & statutory damages, in addition to having the lender pay your attorney fees!
